Memphis Man Finally Free After Months of Mistaken Identity

From Arrest to Atonement

Imagine going about your daily life when suddenly, you’re arrested without any clear reason. That’s exactly what happened to Robertson. He was charged with aggravated rape—a serious accusation that left him reeling. While sitting in a Memphis jail, Robertson was forced to grapple with a nightmare scenario he had only seen on TV before. “I used to watch shows, and… when folks say, ‘Oh no, I’m innocent!’ I’d be like, ‘Nah, you did it,’” he shared. “But, after me experiencing this, there’s probably a lot more people in situations like mine.”

A Shocking Turn of Events

The events leading up to his arrest in February were nothing short of chaotic. U.S. Marshals arrested him while he was in Ohio and then extradited him back to Memphis. It was only after a detailed review of the case that it became clear the indictment had been issued in error. “The state’s trying to confuse me by putting different names on my client,” remarked his public defender, who was left baffled by the numerous name discrepancies.

Attorney Andre Wharton emphasized the seriousness of the situation, stating, “The documentation I read says it all. It just speaks volumes about, we’ve got a lot of problems within our system that we’ve got to fix, and this is one of them.” Wharton noted that the system shouldn’t allow for such mix-ups to happen, particularly in cases involving such severe allegations.

A Struggle for Survival

Sitting in a cell, Robertson was exposed to the harsh realities that come with being labeled a rapist. “When people have those types of charges… they are literally getting beat up every day, almost getting killed, and I just knew one of those days was going to be me,” he recounted. The horrifying thought of an unjust punishment was ever-present.

A Glimpse of Hope

In July, the tide began to turn after months of digging through legal documents and transcripts. “He started telling me the charges, and… after he said aggravated rape, I was just done,” Robertson expressed as he relayed his feelings when first learning about the charges. The situation was so unreal that it felt like a scene plucked straight from a movie. And yet, as time went on, a light finally appeared at the end of the tunnel.

Assessing the Damage

“The Constitution talks about life, liberty, and the pursuit of happiness… all three of them were taken away from Anthony because of a mistake,” Wharton stated, reiterating the fundamental rights that were stripped away during Robertson’s incarceration.

Robertson credited his family, saying, “If I ain’t have my family… I probably would’ve still been sitting there waiting on the public defender to fight for me, cause he did nothing.” With their support, he found the strength to keep pushing for justice against the odds.

Moving Forward

As Robertson begins to navigate his life outside of jail, he carries an important message. “It don’t make no sense for them to drop the ball like that,” he asserted. “They need to fix whatever they did.” His plea is simple: accountability in the justice system is not just crucial for him but for others who could find themselves entangled in a similar situation.

Attorney Wharton is considering legal action but hopes for “an immediate apology and acknowledgment” for Robertson, emphasizing that this is about more than just one man’s story—it’s about a system that needs reform.

The lessons from Robertson’s journey can serve as a reminder that while we often think ‘it can’t happen to me,’ the reality is, it very well could. It’s a crucial moment for Memphis, as citizens reflect not just on the injustices unveiled, but on the importance of a fair and flaw-free judicial process.
