Daniel Morton-Bentley, who’s the deputy commissioner of the New York State Department of Education, sent an assertive letter stating that they don’t think the federal Education Department has the power to enforce the demands being thrown their way. According to the letter, there are neither federal nor state laws on the books that would prohibit the principles of DEI. That’s a pretty strong stance for a state that values inclusivity!

Threats and Funding Concerns

Now, it’s not like the Trump administration was just harmlessly asking for compliance. They actually threatened to cut federal education funding if schools didn’t certify compliance with federal civil rights laws within a mere ten days. To clarify, federal funds represent about 6% of the total funding for K-12 schools in New York. So, it’s a significant amount of cash on the line!

Craig Trainor, acting assistant secretary for civil rights, claimed that receiving federal financial assistance is a privilege. However, many schools, according to him, have recently been found violating their legal obligations concerning DEI programs. That raises the stakes even higher for those involved in educational governance.

The law demanded that state and school officials certify they understood federal funding was completely contingent upon complying with federal civil rights laws. He called out the federal demands as based on a shaky legal interpretation, making it crystal clear that New York isn’t giving in or offering additional certifications any time soon.
